Wisconsin Bar Loses Motion To Dismiss Lawsuit Over Diversity Fellowships

941344Somebody has to fight the good fight. No, not the fight against growing rates of homelessness or voter disenfranchisement. The stuff that really matters, like making sure that none of the Wisconsin State Bar’s dues funds go toward helping minorities. Daniel Suhr’s fight to prevent the Bar from funding a diversity scholarship in the name of free speech just moved a step in his favor. Reuters has coverage:

A federal judge on Monday allowed a lawsuit to move ahead that alleges mandatory membership in the Wisconsin State Bar violates the free speech rights of members who object to certain initiatives of the association including diversity programs.

The fight isn’t over. He has to still beat the Bar in court and they plan on defending their actions. They had this to say:

The Wisconsin State Bar will demonstrate to the court that its activities and procedures are “constitutionally permissible,” said president Ryan Billings on Tuesday, adding that similar legal challenges have been unsuccessful.

As strange of a hill this is for Suhr to die on, it is nice to know that the Wisconsin Bar didn’t immediately fold to his complaints.
