Most judges would agree that, under ordinary circumstances, sentencing represents their most difficult and complex responsibility. In this case, the determination is further complicated by an extrinsic factor that looms large in nearly every bail and sentencing determination made in this judicial district: the dangerous, barbaric conditions that have existed for some time at the Metropolitan Detention Center (“MDC”) in Brooklyn.
—U.S. District Court Judge Gary Brown of the Eastern District of New York in ruling that he will vacate a white-collar sentence if the defendant is assigned to MDC. He continued, “While evidence of failures at MDC continues to accumulate, there is no complete public record of the problem, and the available information is contained in judicial opinions from two districts and sporadic media reports.” Judge Brown then proceeded to detail the horrific incidents at MDC — a must read (below) for those concerned about the federal justice system.
